Terms of Use of Telemedicine Services

Please carefully go through these terms and conditions (“Terms”), the terms and conditions of the Website, and the privacy policy available at (“Privacy Policy”) before you decide to access the Website or avail the telemedicine services (the “Services”) made available on the Website by the Company.

 

If you wish to avail of the telemedicine services offered by the Company, you hereby provide your express consent by clicking on the ‘I Accept’ box, confirming that you have read and understood the below Terms, the terms and conditions of the Website and that you accordingly provide your informed consent for the Services.

 

 

1. Age Requirements

 

 a. If you are under the age of 18 (eighteen) years, you must have your parent or legal guardian’s permission to avail of the Services. Please have your parent or legal guardian read these terms with you.

 

 b. If you are a parent or legal guardian, and you allow your child to avail of the Services, then these terms apply to you and you are responsible for your child’s activity vis-à-vis the Services, and you shall be physically present along with your child, during the Service.

 

2. General Conditions related to the Services

 

a. You understand that the Services are being provided via telecommunications and digital communication technologies including Voice, Audio, Text & Digital Data exchange.

 

b. You understand that any of the Registered Medical Practitioners (“RMP”) that you may engage with for the Services, by booking an appointment, with such RMP, are all registered practitioners enrolled with the State Medical Council or the Indian Medical Council in accordance with applicable law.

 

c. You understand that such RMP may seek valid information from you for the purposes of any diagnosis and /or treatment.

 

d. You may consult with an RMP for diagnosis and treatment of her condition or for health education and counselling.

 

e. You may use the Service for follow up consultation on your ongoing treatment with the same RMP who prescribed the treatment originally.

 

f. By initiating a telemedicine consultation, you agree that you have provided implied consent for the Service, by your action.

 

g. If you as a parent or legal guardian are initiating the telemedicine consultation on behalf of your child, you shall provide require your child to expressly state (in her own voice) that she consults to the Service, and the RMP shall have recorded such express consent.

 

h. You understand that there may be delays in evaluation or treatment could occur due to failure of the electronic equipment, or owing to poor internet connectivity.

 

i. You understand that the RMP will not be conducting any physical examinations and accordingly will not be able to gain any relevant information that may usually be obtained through a physical examination. You further confirm that you understand this limitation and the risks that may be involved owing to such limitation.

 

j. You understand that the Services are not a substitute for treatment that otherwise needs a physical examination or immediate consultation.

 

k. You understand that the Services are not intended to be a substitute for getting in touch with emergency healthcare. In case of any emergency, please contact your nearest hospital or physician.

 

l. If required to do so by the RMP, you consent to share any (history/examination findings/Investigation reports/past records etc, which can enable the RMP to exercise proper clinical judgment.

 

m. You understand that the RMP may as part of the Services, impart health promotion and disease prevention messages, including those relating to diet, physical activity, cessation of smoking, contagious infections and so on, and such messages are meant for educational purposes, and do not have any adversarial intention.

 

n. You understand and agree that the RMP may charge an appropriate fee for the Services, and you undertake to pay such fee in a timely manner, in accordance with the procedures set out on the Website, or any other procedures that may be communicated to you by the RMP.

 

o. You shall not use abusive language with the RMP, and in the event of any abusive language being used, you understand that the RMP has the right to terminate the consultation.

 

p. You agree that the Company can record, save and store all tele-consultations for record purposes and produce these as evidence if required before or directed by a court of law.

 

q. You understand that in addition to your RMP, there may be another RMP member of the Company, during the Service, and consent to such presence.

 

r. You understand that the RMPs are independent professionals in private practice and are not agents of the Company. The Company does not promote or suggest any particular RMP, nor does it make any representations or warranties with respect to RMPs or the quality of the healthcare services they may provide.

 

s. You hereby accept and acknowledge that the Service is between the RMP and you and the Company has no role to play in it. In an event of any wrongdoing or any mishap or any negligence then the Company will not be held liable for any loss or damage if any.
